Probate Litigation

Kelley Franco has extensive experience in probate litigation.  This is the practice of handling probate matters that become litigious.  She is particularly skilled at representing executors and trustees in contested matters in Probate Court and on probate appeals in Superior Court.  Examples of such cases are defending trustees when they are sued.  In Probate Court, these lawsuits often take the form of an objection to an accounting filed by a trustee.  Representative clients include JPMorgan Chase, BNY Mellon, and the U.S. Trust Company division of Bank of America.  Kelley has also represented individual trustees.

Kelley has also handled numerous will contests in Probate Court and on appeal to Superior Court for local families.  She has also litigated conservatorships. She regularly appears before the probate judges of lower Fairfield County.
